GroundGuardians is committed to maintaining the accuracy, confidentiality, and security of your personally identifiable information. This Privacy Policy describes how we collect, use, and safeguard your data when using our utility locate management services.

1. Information Collection

We collect specific personal and project information necessary to process utility locate requests. This includes your name, contact details (email, phone), company information, and specific dig site details (address, depth, scope of work).

2. Use of Information

Your information is used strictly to:

• • Submit and manage locate requests with Ontario One Call.
• • Coordinate with utility infrastructure owners (e.g., Gas, Hydro, Telecom).
• • Communicate application status, renewals, and deliver final locate packages.

3. Information Sharing

We do not sell, rent, or trade your personal data. We share necessary project details with Ontario One Call and registered utility owners solely to fulfill legal locate requirements and ensure safe excavation practices.

4. Data Retention & Security

We employ robust security measures to protect your data. Project records are retained to assist with validity monitoring, renewal management, and dispute resolution.

1. Agreement to Terms

By using GroundGuardians Consulting & Management services, you agree to be bound by these Terms of Service. We provide utility locate management and coordination services, acting as an authorized agent on your behalf in connection with Ontario One Call and relevant utility owners.

2. Service & Accuracy

We prepare and submit locate applications based solely on the information you provide. You warrant that all project details — including address, excavation depth, scope of work, and proposed start date — are accurate and complete. GroundGuardians is not responsible for application delays, rejections, or errors arising from inaccurate or incomplete information provided by the client.

3. Payment Terms

One-off Applications: Payment is due upon receipt of invoice prior to or upon submission of the application.

Standard and Extensive Plans (Monthly Subscriptions): Subscription fees are billed monthly on the renewal date. Payment is due within 3 business days of the renewal date. If payment is not received within this period:

• • Dedicated support will continue for any actively in-progress applications for a period of 2 months from the renewal date, and will continue once payment is received.
• • No new locate applications may be submitted under the subscription during the non-payment period.
• • Permit renewals for active locates may still be submitted during the 2-month support window.
• • After the 2-month support window, all service obligations cease and the subscription is considered cancelled.

We reserve the right to suspend or terminate service immediately if payment is not received and no communication has been made within the 3-business-day window.

4. Cancellation & Refund Policy

One-off Applications: A full refund will be issued if cancellation is requested before the application has been submitted to Ontario One Call. If cancellation is requested after submission, a 30% administrative fee will be deducted from the refund to cover labour and processing costs already incurred.

Standard and Extensive Monthly Plans: A full refund of the current billing cycle will be issued if cancellation is requested before any applications in that cycle have been processed or submitted. If one or more applications have been submitted within the current billing cycle, a 30% administrative fee applies to the pro-rated value of submitted applications within that cycle. Fees already earned through completed work are non-refundable.

To request a cancellation or refund, written notice must be sent to groundguardians01@gmail.com. Verbal cancellations are not accepted.

5. Liability Limitation

GroundGuardians provides administrative coordination only. We do not physically mark utility lines. We are not liable for the accuracy, completeness, or timeliness of field markings placed by utility owners or third-party locate companies. GroundGuardians is not responsible for any property damage, personal injury, utility strike, service disruption, or financial loss arising from excavation activities, regardless of whether a locate permit was obtained through our service. Safe excavation practices, including adherence to all applicable Ontario legislation, remain the sole responsibility of the contractor, homeowner, or excavator.

6. Service Termination

Either party may terminate services with written notice to the other party. GroundGuardians reserves the right to terminate services immediately and without notice in cases of non-payment, violation of these terms, or misuse of the service. Upon termination, any active applications already submitted to Ontario One Call will be allowed to run to completion within the standard validity period; no new submissions will be made.

7. Record Retention

Application records, locate packages, and correspondence will be retained for a minimum of 1 year from the date of service. Clients may request copies of their records during this period by contacting us at groundguardians01@gmail.com.

8. Governing Law

These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
